PRIVACY POLICY

This privacy policy applies to the personal data you send us via the websites https://www.finehomesandestates.be/ and https://www.century21.be/ as well as https://www.century21.lu/, all of which are managed by CENTURY 21 BENELUX S.A. (hereinafter "Century 21 Benelux" or "we"), as well as to the data you may send us via our other contact channels.

Respecting your privacy and your personal data is a priority for us. On this page, we would like to explain how we handle and protect your personal data.

1. PERSONAL DATA

The term "personal data" has for us the same meaning as that given to it by Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter "General Data Protection Regulation" or "GDPR"), namely: any information relating to a natural person who is identified or can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, etc.

The personal data concerning you that we intend to process, insofar as you provide them to us, are the following (hereinafter "Your Data"): your surname, first name, telephone number, postal address, e-mail address, as well as any other information that you provide to us through our websites or our various contact channels.

2. DATA CONTROLLER

The legal person responsible for processing Your Data (called the "Data Controller") is CENTURY 21 BENELUX S.A. We are a public limited company under Belgian law whose registered office is located at Drève Richelle 161 B, P.O. Box 10, 1410 Waterloo, Belgium. Our company is registered with the Crossroads Bank for Enterprises of Belgium under number 0451.724.941.

3. PROCESSING OF YOUR DATA IN ACCORDANCE WITH THE GDPR

Your Data is collected through the forms available on our websites that you fill in and send to us, or through any other contact channel you use to communicate with us. They are processed in compliance with the GDPR, as specified below.

4. PURPOSES OF PROCESSING YOUR DATA

Century 21 Benelux intends to process Your Data only for specific and limited purposes. These purposes are as follows:

To allow the CENTURY 21 agencies in our network (operated by franchisees) that can best meet your needs to contact you;

Management of the customer relationship between you and the agencies of our CENTURY 21 network (we want to know your satisfaction and any comments you may have about the services provided by our agencies, so that we can constantly improve);

To keep you informed of news relating to our network or the real estate market in general, as well as actions, promotions and competitions organized by or in collaboration with the CENTURY 21 network, by sending newsletters or e-mail alerts, which you may unsubscribe from at any time.

5. LAWFULNESS OF THE PROCESSING OF YOUR DATA

In view of the above-mentioned purposes, we base the processing of Your Data on the following legal basis:

Article 6 §1, f) of the GDPR: "processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party".

6. HOW LONG WE KEEP YOUR DATA

Initially, we will retain Your Data for 2 years from the time you provided it to us. At the end of this period, we will ask for your consent to extend the retention period by one year each time. In the event of refusal, your personal data will be rendered anonymous.

7. DISCLOSURE OF YOUR DATA TO THIRD PARTIES

We may transmit Your Data to real estate agencies of the CENTURY 21 network in the Benelux (operated by franchisees), in order to achieve the first or second purpose mentioned in Article 4 of this Privacy Policy.

In order to let you know about new products, actions, promotions and competitions organized by or in collaboration with the CENTURY 21 Network (the third purpose mentioned in Article 4 of this Privacy Policy), we may occasionally communicate Your Data to other trustworthy third-party companies.

Under no circumstances will we transmit Your Data to third parties located outside the European Economic Area.

8. PROCESSING OF YOUR DATA BY PERSONS ACTING IN OUR NAME AND ON OUR BEHALF

Your Data may be processed by people acting in our name and on our behalf, such as our staff (employees or self-employed), who are subject to a contractual obligation of confidentiality, and our processors within the meaning of Article 4 of the RGPD (hereinafter "processors"). CENTURY 21 BENELUX ensures that the processors it works with guarantee the same level of protection as the one it applies itself to personal data, and requires a contractual guarantee that these processors will process Your Data exclusively for the authorized purpose, with the required discretion and security (in other words: we enter into data processing agreements, within the meaning of the GDPR, with our processors).

9. YOUR RIGHTS TO YOUR DATA

In accordance with Article 21 of the GDPR, you have the right at any time to object to the processing of Your Data for one or more of the purposes listed above, or to the communication of Your Data to one or more of the third parties listed above.

You also benefit from other rights under the GDPR, such as in particular a right of access to Your Data (in accordance with Article 15 of the GDPR), a right to rectification of Your Data (in accordance with Article 16 of the GDPR), a right to erasure of Your Data (in accordance with Article 17 of the GDPR), a right to limitation of the processing of Your Data (in accordance with Article 18 of the GDPR), and a right to portability of Your Data (in accordance with Article 20 of the GDPR).

10. SECURITY AND CONFIDENTIALITY OF YOUR DATA

Access to Your Data collected by Century 21 Benelux is limited to authorized employees and self-employed staff of CENTURY 21 BENELUX, who need to know it as part of their duties and who are bound by a contractual obligation of confidentiality.

Furthermore, to guarantee the security and confidentiality of Your Data collected by Century 21 Benelux, we only work with subcontractors (within the meaning of Article 4 of the GDPR) who can guarantee the implementation of the highest security standards.

11. SENDING ADVERTISING BY E-MAIL

As mentioned above, we will be happy to share with you by e-mail our newsletters, competitions or other information that may be of interest to you. As mentioned above, you have the right at any time to object, free of charge, to the use of your e-mail address to receive advertising offers from CENTURY 21 BENELUX or its partners.

Our websites may contain hyperlinks to other websites that are neither operated nor controlled by CENTURY 21 BENELUX (e.g. in the case of commercial partnerships with third parties). CENTURY 21 BENELUX cannot be held responsible for the content of such websites, nor for the data protection practices of the third parties that operate them, which may differ from our own.

13. MODIFICATION OF THE PRIVACY POLICY

This Privacy Policy replaces all previous versions and applies from 28 October 2024. We reserve the right to modify and/or update this Privacy Policy at any time, in order to comply with applicable privacy and data protection legislation or to adapt it to our practices.

We therefore invite you to consult it regularly for any changes. We will not make any changes that would reduce the level of protection of your rights, as guaranteed herein, without obtaining your prior consent.
